A MAN has been spared jail after he showed a "flagrant disregard" for his driving ban by getting back behind the wheel.

Kevin Jones, of Heol Y Bryn in Penycae, appeared at Wrexham Magistrates Court on Tuesday.

The 41-year-old admitted offences of driving whilst disqualified and driving without insurance.

Both offences took place on June 24 at Ffordd Llanerch in Penycae.

Prosecutor Justin Espie told the court that the defendant as stopped by police just before 5pm on the day in question.

He immediately confirmed to the officer that he was banned.

Having heard an indication from District Judge Gwyn Jones that he intended to pass a non-custodial sentence, Lorraine McClure, defending, made no representations to the court.

The defendant confirmed to the Judge that he had no physical or mental difficulties - or drink and drug issues - to prevent the imposition of unpaid work.

As such, District Judge Jones told him: "Clearly the starting point must be immediate custody, and your record does you no favours.

The Leader:

"You were driving within a short period of time of being banned by the court.

"It was a deliberate and flagrant disregard for the order of the court.

"But you have pleaded guilty and there is some hope for you.

"I can draw back from immediate custody."

The defendant received a 16 week custodial sentence, suspended for 12 months.

He was banned for 12 months and must pay £85 costs, as well as a £154 victim surcharge.
